*By participating in our 3DFashion program (“Program”) or using any of its features, you acknowledge, warrant and agree that:
In order to participate and to maintain and improve the Program we may need to use your name in our platform or other relevant publication. In respect hereof, you hereby grant us a limited non-exclusive, non-sub-licensable, royalty-free, and worldwide license to use your use your name, logo, tradename or other marks.
The Program may include certain features which will enable you to sell or provide services through your participation in the Program to certain end-customers. You are solely responsible for your products, services and related activities, as well as your competence, adequacy and compliance with any laws applicable thereto. Stratasys is not involved in your relationship and/or any transaction with any actual or potential end-customer of your products, services or activities, whether related to the Program or otherwise.
You are solely responsible for any and all statements and promises you make and for all assistance, warranty and support regarding end-customer transactions and activities. You may not offer or provide any end-customer services, products, or provide any related information, content or material, which may be deemed prohibited, non-compliant, hazardous, counterfeit or fraudulent; or which otherwise fail to comply with any applicable laws, including with respect to consumer rights, intellectual property, product safety, trade regulations and export.
Stratasys reserves the right, at any time and at its sole discretion to change any part of this Program at any time without prior notice. This includes, but is not limited to, Program features, availability, and compatibility. Stratasys also reserves the right, at any time and at its sole discretion to discontinue this Program at any time, either temporarily or permanently, without any liability to any party. Further, Stratasys may, at any time and at its sole discretion, suspend, disable or remove you from the Program and/or your name from any Stratasys platform or publication related to the Program, without any liability to you or to any end-customer/s, including for any capacity loss resulted therefrom.
By taking part in this Program provided by Stratasys, you agree to these terms and acknowledge that Stratasys will not be responsible or liable for any damages or losses that may arise as a result of your participation, any changes or discontinuation of the Program or related end-customer transactions.
If you do not agree with any of the terms or conditions, you should discontinue your participation in the Program immediately.
The Stratasys 3DFashion design and printing service platform and program enables you to engage, connect, further develop and procure certain third-party services and/or products and access to Stratasys partners from which you may purchase such third-party services, products and/or tools (collectively “Third Party Service/s”).
You acknowledge and agree that regardless of the manner in which such Third Party Services may be offered to you (bundled or integrated within certain Stratasys services, offered separately or by persons certified or authorized by Stratasys, connected independently by you or otherwise offered), Stratasys merely acts as an intermediary between you and such Third Party Services, and is not in any way responsible or liable with respect thereto. Stratasys will not be a party to, or in any way be responsible for monitoring, any interaction or transaction between you and any of your selected Third Party Services.
Your use of any Third Party Services is offered on an at-your-own-risk and responsibility, with all that it entails and may be subject to separate such legal and financial terms which govern such Third Party Services and your relationship with the relevant provider/s of Third Party Services, which you are encouraged to review before engaging with them.
You acknowledge that such services may require the payment of additional amounts to the relevant provider/s of such Third-Party Services.
Stratasys may, at any time and at its sole discretion, suspend, disable access to or remove from your User Account, User Platform(s) and/or the Wix Services, any Third Party Services – whether or not incorporated with or made part of your User Account and/or User Platform(s) at such time – without any liability to you or to any End Users.
EXCLUSION OF LIABILITY.
For avoidance of doubt, Customer shall remain fully responsible whether or not and to what extent he chooses to acquire and use Third Party Services. Stratasys is only liable for the products and services provided by itself and only to the extent pursuant to Stratasys Terms and Conditions of Sale. To the extent permitted by law, any non-Stratasys services and products, even if such were promoted or sold by Stratasys to end-customer are provided “as is” with no warranties whatsoever, other than those warranties expressly provided to Stratasys by the Third Party Service provider of the applicable Third Party Service, to the extent that these can be provided by Stratasys. Stratasys in no event shall be liable for any direct, indirect or consequential damage or loss that the end-customer may incur resulting from purchasing and/or use of any Third Party Service or third-party product/s.
